Every business in the UK must appoint a Competent Person by law to advise on their health and safety matters. The higher the risk and the complexity of the operations involved in the business will necessitate the experience and/or qualifications required. You must have help from a competent person in order to meet the health and safety law requirements.
When seeking to appoint a Competent Person, preference should be given to those in your own organisation who possess the required level of competence (this can include the employer themselves) before looking for help from outside. In many situations, however, the Directors and staff, although being highly trained and experienced in what they do, may possibly lack the health and safety knowledge or time required to adhere to what is required within their workplace.
In many instances it is prohibitively expensive to employ someone in that singular role and the role would not warrant a full-time position. Staff will not always be keen to take on the extra responsibility and training required.
